What is New Brunswick Business Immigration Stream?

The New Brunswick Business Immigration Stream is targeted for experienced entrepreneurs who are ready to establish, operate and actively manage a business while living in New Brunswick permanently. Applicants can establish a new business or purchase an existing one. Applicants must meet the minimum eligibility requirements. The Department of Post-Secondary Education, Training and Labour (PETL) reserves the right to consider only certain types of new businesses or the purchase of existing businesses for economic development. When PETL approval the application, a letter of support for a Work Permit will be issued. After receiving a Work Permit, the applicant arrives in NB and establish the approved business. In the two-year Business Establishment Period (BEP), the applicant must have operated the business for one year according to the terms and conditions set out in the Business Performance Agreement (BPA). PETL will require document, conduct a site visit and an interview to assess whether all conditions of the BPA have been met. If successful, the applicant will be issued a nomination certificate, and apply to IRCC for Permanent Resident.

What are the requirements of the NB Business Immigration Stream?

These are generally the requirements of this program.

1. Business Requirements

  • The business must be of economic benefit to the province;
  • The business must be established as a sole proprietorship, partnership or corporation. In the case of partnership, the other partner(s) must be a Permanent Resident or Canadian Citizen;
  • The business must be the continued operation of an existing business or the establishment of a new business;
  • The business must be a private-sector, for-profit entity with the primary purpose of earning profits through the sale of goods and/or services;
  • The business must be considered a “permanent establishment” as defined under S 400(2) of the Canadian Income Tax Regulation, 1985

2. Economic benefit to NB economic

Priority processing may occur for applications with business plans that have the greatest potential to create significant economic benefit through:

  • increased value-added manufacturing or processing for New Brunswick exports;
  • enhanced research and development;
  • development of new products and/or services;
  • development of innovative approaches to traditional businesses;
  • development and/or enhancements of new technologies;
  • the transfer of technology and specialized knowledge to New Brunswick;
  • providing products and/or services to an under-served local or regional market; and
  • immediate needs identified in specific regions or communities;
  • other, as determined by PETL.

3. Investment

When investing in a business, the applicant must:

  • make an eligible business investment of not less than CAD $150,000 before tax.
  • The applicant must control at least 33.3% equity in the business.

4. If buying an existing business, the applicant must demonstrate that the business:

  • has been in continuous operation by the same owner for the three years prior to the purchase date; and that the owner is a permanent resident or citizen of Canada.
  • will be purchased at a proven fair market value.
  • has achieved a proven net profit for at least two of the previous three years as demonstrated by audited financial statements and corporate tax assessments issued by CRC.
  • will provide for the continued employment to existing staff on similar terms and conditions.
  • is not in receivership and/or has not filed for bankruptcy for the three years prior to the date of purchase.
  • Goodwill may not exceed 10% of the net book value when purchasing a profitable business.

7. The applicant must provide active management to the business.

8. Complete a Net Worth Verification Report after receiving an ITA.

9. Presence in NB.

During the establishment of the business, you must:

  • reside in NB 75% of the time of your Business Establishment Period (BEP), and
  • reside within 100kms of your place of business.

10. Cooperation with PETL when they conduct a site visit and interview with you.

12. Your business should be in one of the Key sectors, which include: manufacturing, information and communication technology, cybersecurity, value added wood, agriculture, aquaculture, tourism, digital health, food and beverage, contact/call centres, energy innovation, and aerospace and defense. 13. Exploratory visits must be at least five full business days, and an Exploratory Visit Report must be submitted.

14. You must intent to reside in NB.

15. If all the above requirements have been met, the applicant will be assessed against a point system. A minimum of 65 of 100 points is required.

4. Personal Net Worth

The applicant must have a verifiable personal net worth of at least CAD $500,000. The net worth must be legally obtained and must be verified by a third-party professional designated by the Department. The applicant must disclose full net worth. Inheritances, donations, and gifs received less than six months before the application will not be considered eligible.

No points are awarded for meeting the requirements for personal net worth.

5. Business Ownership/Work experience

As a business owner you may be awarded up to a maximum of 15 points considering:

  • you must be the business owner (of at least 51%) for at least three out of the last five years; and
  • be responsible for supervising at least two employees.

Based on your senior management experience you may be awarded up to a maximum of 9 points.

  • you manage the organization, a department, division, or component of the organization; or an essential function within the organization; and
  • you are the senior manager in a business in three out of the last five years; and
  • you are responsible for supervising at least two employees; and
  • you have the authority to hire and terminate employment, or recommend these and other personnel actions, such as promotion and leave authorization; and
  • you are personally involved in the day-to-day operations as a primary decision maker; and
  • you must have been actively involved in a for-profit company that is not owned or operated by a government or voluntary sector.

6. Business Concept (Maximum 25 points)

The applicant must submit a business concept. The applicant must demonstrate that the business concept is of economic benefit to NB, and that the applicant have conducted extensive research and considered relevant economic, market and cultural factors.
